Respected Judge of the Court,

I am Sukhdev Singh, son of Sardar Mengha Singh Banwait, resident of 16FF, Karanpur (Rajasthan). I was arrested from Pimpri-Chinchwad railway station on 7th September 1986. Since then, I have been incarcerated in Yerawada Jail. Three cases have been registered against me in this court and one has been adjudicated upon. In the case concerning the evil Vaidya, you laid out a number of accusations against me and a number of others on 2nd September 1988. You asked us whether the charges brought by the public prosecutor were agreeable to all of us or not. At that time, I answered ‘no’ because 90% of the allegations were lies. At that time you did not ask anything in detail. I wanted to tell you everything when you would be able to ask detailed questions in court.

 

When I spoke to my lawyer about this, he refused to continue to fight the case as my representative. I had taken on a lawyer as the police made false allegations against me and have established dishonest witnesses. These include the Pimpri case. I wanted my legal representative to fight these falsified cases in court and that I would tell the truth about what I did, but my lawyer did not agree. If my lawyer agrees to represent me as I instruct then it is agreeable; he could return to take on the role now.

 

The evil General Vaidya was eliminated by me (Sukhdev Singh) and Harwinder Singh alias Matra Singh, son of Sardar Gurdeep Singh, resident of Chaura Madhra, Gurdaspur. At that time Harwinder Singh alias Mathura Singh was riding a black Indo-Suzuki. I was sitting behind him. I fired four bullets at the evil General Vaidya. Later, I discovered from newspaper reports that one bullet had hit his wife. I had no intention of killing his wife because she had not committed any sinful deeds as the evil General Vaidya had.

 

I and Harwinder Singh came to Pune on 8th August 1986. We stayed at the Gurdwara Sahib. On 9th August, we stole a black Indo-Suzuki motorcycle from the market. We both set out on 10th August to wreak vengeance upon the evil General Vaidya and the evil Lieutenant-General Dayal. At first, we rode past the evil Dayal’s house. Then we went to the front of the evil Vaidya’s house and his car was about to drive out. Mathra Singh and I had seen his photograph in the newspapers and magazines. We both recognised him and followed his car in order to execute him.

 

The evil Vaidya was the Chief of the Indian army and the evil Dayal it’s Lieutenant General. They had attacked our Sri Darbar Sahib Amritsar and forty other Gurdwaras. Thousands of innocent Sikhs were martyred and the sanctity of the house of the Guru was violated. Sri Akaal Takht Sahib was demolished using tanks and canons. Thousands of Sikh men, women and children were martyred in utter cruelty. The Government of Delhi was not only engaged in a war against Sant Jarnail Singh Ji Khalsa Bhindranwale, but against the entire Sikh Qaum and continues to be so. It is due to these reasons that Mathra Singh and I executed the evil Vaidya and having obtained work, we would have remained in order to do the same to the evil Dayal.

 

In order to make this case into a bigger conspiracy, the CBI has followed the guidance of the Government of Delhi and falsely implicated many innocent people, accusing them of conspiracy to murder, aiding and abetting in the murder of the evil Vaidya, and of providing assistance in the conspiracy.

 

Harjinder Singh alias Jinda, Balwinder Singh alias Binda, Nirmal Singh alias Nimma, Avtar Singh Randhawa, and Yadvinder Singh Pirzada, and others whose names I do not know (my chargesheet is with my lawyer, otherwise I would have read it and provided their names) have no connection to me regarding this case, or any other case, now or in the past. I did not know them and never saw them before. Of the unknown persons listed on the chargesheet, only Harwinder Singh alias Mathra Singh is known to me. I have no relationship with any other man listed.

 

I first saw Nirmal Singh whilst detained at the Pimpri police station. The others I met for the first time at the Yerawada jail.

 

You sentenced me to seven years in the Pimpri case. You had to give me this sentence on account of the false witnesses who were presented to the Court. False testimony can even lead to the gallows. I have no anger about this sentence. The determination you made of the confessional statement in the Pimpri case was entirely correct. I gave no confessional statement to magistrate S. L. Khatade, nor did I do so before any police officer. After the chargesheet regarding the evil Vaidya’s case was filed, I made an application on the first date before you to state that this confession was false.

 

The Hindus of Punjab have abandoned their mother tongue Punjabi and adopted Hindi and even that they state in Punjabi – that Hindi is their mother tongue. Seeing the demands of the people of Punjab as the demands of the Sikhs, they have opposed our cause and to this day they seek to divide themselves from us in opposition. Considering the attack on Sri Darbar Sahib Amritsar as a victory, they distributed sweets. Those institutions of the Sikhs from where Sri Guru Tegh Bahadur Sahib Ji Maharaj came to Delhi to sacrifice himself for freedom of belief, were the same that the Hindus were happy to see destroyed or filled with corpses. Those Sikhs whom the Hindus have been opposing are those same people who have given their lives for the country and to fight oppression. 84 percent of the sacrifices made for the freedom of India belongs to the Sikhs.

 

Sri Guru Arjan Dev Ji Maharaj was also martyred at the behest of a Hindu Chandu Brahmin. Mata Gujri Ji and two sons of Sri Guru Gobind Singh Ji Maharaj were also martyred at the behest of a Hindu Gangu Brahmin.

 

In 1733, Zakariya Khan had forced the Sikhs to escape to a life in the jungles. The Sikhs had to make do on a diet of roots and plants. Capturing a Sikh alive and handing them over was rewarded with a hundred rupees. Hindus and Muslims of that time captured and caused the martyrdom of Sikhs on a grand scale in order to reap the rewards. Similarly today, the Hindu Government of Delhi has placed bounties on the heads of the Sikhs. They had placed a reward in the hundreds of thousands on the head of Harwinder Singh alias Mathra Singh.

 

When Ahmed Shah Abdali, Nadir Shah and Zakariya Khan first made their onslaught on to the sub-continent, they would attack the Hindus, rob from them and take away their daughters and daughters-in-law; at that time, a handful of Sikhs would attack them in the Punjab and seize their loot, freeing the daughters and daughters-in-law, returning them back to their homes. Now, what the same Hindus have done to Sikhs in Delhi and other parts of India from 1984 until today is indescribable.

 

When the Sikhs reclaimed the snatched loot from Nadir Shah, he asked of Zakariya Khan who these people were. Zakariya Khan replied that these were the Sikhs of Sri Guru Nanak Dev Ji Maharaj, who make their horses saddles their homes and fight against oppression. If they come to an agreement with me, I will give them the Governorship of Punjab thought the invader; but the Sikhs did not compromise with the oppressors and sustained their battle against oppression.

 

Our struggle is not against any religion or caste

 

Our fight is for the truth. The Government considers this a crime, denigrating the Sikhs by terming us as terrorists and anti-nationalists, despite the Government itself being anti-national, killing and having killed thousands of innocent Sikhs following the vanquishing of the evil Indira Brahmin. Those who murdered and had murdered those Sikhs had no charges laid against them in any court. The Government has spread terror among the Sikhs through its agents. The latest example is Guru Nanak Dev Engineering College Bidar (Karnataka) where Sikh students were killed and many more were injured. The college was forcibly closed. Even the newspapers only gave a brief report of the happening four or five days after the event, whilst any such news from Punjab is grossly exaggerated. No action has been taken against the people responsible for this incident so far. In Maharashtra too, there has been a call to boycott local Sikhs both socially and economically. No legal action has been taken against those who raised these cries. If any Sikh looks to take issue with these evil ones, they will be called a terrorist and anti-national. Sikhs are locked up in prison and shot at for making legitimate demands over their equal rights. Thus, the Government has forced us to take up arms.

 

What kind of rule of law is there in this country, that those who assassinate the evil Brahmin Indira are hanged and yet on the same day those who murdered and had murdered thousands of Sikhs are given seats of power? Is this what the constitution of India is for, to inflict so much oppression upon the Sikhs? Sikhi and the Sikh Qaum were not given recognition as other religions were, despite the Sikh way of life and the Sikh Qaum being a distinct religion and community. There is no protection or sense of security for the Sikhs under this constitution.

 

Bhairao, Fifth Mehl:

I do not keep fasts, nor do I observe the month of Ramadaan.

I serve only the One, who will protect me in the end. ||1||

The One Lord, the Lord of the World, is my God Allah.

He administers justice to both Hindus and Muslims. ||1||Pause||

I do not make pilgrimages to Mecca, nor do I worship at Hindu sacred shrines.

I serve the One Lord, and not any other. ||2||

I do not perform Hindu worship services, nor do I offer the Muslim prayers.

I have taken the One Formless Lord into my heart; I humbly worship Him there. ||3||

I am not a Hindu, nor am I a Muslim.

My body and breath of life belong to Allah – to Raam – the God of both. ||4||

Says Kabeer, this is what I say:

meeting with the Guru, my Spiritual Teacher, I realize God, my Lord and Master. ||5||3||

(Ang 1136, Sri Guru Granth Sahib Ji Maharaj)

 

These words were written by the fifth Guru Nanak, Sri Guru Arjan Dev Ji Maharaj, in Sri Guru Granth Sahib Ji Maharaj. The central idea of this Shabad is that we are neither Hindus nor Muslims. The Government of India and the Hindus consider the Sikhs to be Hindus. They do not consider the Sikh way of life and the Sikh Qaum as a distinct entity. Upon reading these words, the Government of India and the Hindus should come to know just who the Sikhs are. There are many such examples that can be found in Sri Guru Granth Sahib Ji Maharaj.

 

The Rowlatt Act was enacted by the British during their rule in the subcontinent. The Congress party protested very strongly against it. Now the same Congress party Government has created ‘TADA’ which equates to a modern day Rowlatt Act. None have raised a voice against it.

 

The British had amended the witness laws (Evidence Act) in 1877. The alteration stated that the testimony of Indian police officers was not to be accepted in court as they are capable of entrapping any innocent person through false means. Now this Government has given police officers the authority to testify and stated that the Court should accede to their witness statements. If they make a mistake in ‘good faith’ then no action can or will be taken against them in court.

 

Now even the first class magistrates of this country provide false testimony in court. As I have already told you previously and you yourself determined in the Pimpri case at the time.

 

In his review of the Operation of the Prevention of Terrorism Act 1976 (England), Lord Jellicoe stated, “this type of law is a symbol that the terrorists have won.”

 

All Governments call those who fight for freedom ‘terrorists’. Those freedom fighters who brought independence to India are termed terrorists still to this day. (One man’s terrorist is another’s freedom fighter – as the saying goes).

 

On 25th November 1949, the chairman of the Drafting Committee of the Constitution, Dr Ambedkar stated: “those who are called to work it, happened to be a bad lot”.

 

“There is no crueler tyranny than that which is perpetrated under the shield of law and in the name of justice.” – Charles de Montesquieu.

 

The demand for Khalistan is due to the atrocities that have been committed and are being committed against the Sikhs. Until Khalistan is achieved, the fight against the evil doers will continue.

 

We petition Waheguru in the morning and evening:

The Khalsa will rule,

None shall defy it.

 

This means that the pure and holy individual should rule and none should feel suffering in that kingdom. In a country where Sikh youth are being brought out of prisons to be martyred, martyred through fake police encounters, where thousands are incarcerated in prison on false charges, and Sikh institutions are being desecrated, how can a Sikh of the Guru reside in that country?

 

Without sovereignty there is no righteousness nor justice.

Without righteousness and justice all is lost and futile.

I am prepared to make every kind of sacrifice for Khalistan and the Sikh Qaum.
